Rossbank instructs lawyers over Kensington dispute

Rossbank claims Kensington is in breach of a five-year contract to outsource mortgage processing to its Cheltenham call centre. Non-conforming lender Kensington said it ended the contract due to poor service standards from Rossbank.

Kieran Hedigan, Rossbank’s chief executive, said: “Kensington’s current advertising campaign refers to the art of non-conformism. Well they appear to be suffering from the art of self-delusion. Their legal case is weaker than King Canute’s attempt to deny the daily turn of the tide. I truly believe that this case will wash up on the steps of Kensington’s grand new offices in Paddington Basin with damaging consequences.”

Hedigan went on to say Rossbank would be seeking witness statements from the Kensington board including chairman Peter Birch, chief financial officer Simon Kingdon and chief executive John Maltby.

Kensington Mortgages claims it has received no word from its lawyers regarding court proceedings. The lender released the following statement: “Due to a confidentiality agreement being in place, Kensington Mortgages has always declined comment on this matter unless in response. Kensington has not received any notification from Rossbank’s lawyers that it has commenced legal proceedings. Nor does it believe it is in breach of contract.”
