Solicitors conduct the exchange of contracts for a house purchase at which point the contract of sale becomes legally binding. The solicitors then also organise the completion of the sale and transfer the funds between seller and buyer and/or mortgage lenders.

Can you buy a property before selling yours?

If you can afford to buy a property in addition to your current one, then it is of course possible. If you need to sell your property prior to purchase, some estate agents do not allow you to put an offer on another property without at least an offer being in place on your current home.  

There are benefits and drawbacks to each option:  

  • by buying before selling you need to be able to ensure you can afford it, but if you can then it will take away the pressure of having to find another property because you have accepted an offer on your current property;  

  • however, you will also have to consider additional Stamp Duty and Capital Gains Tax that will be incurred for owning two properties at once, even if for just a short time.  

  • Selling before buying will mean that you know how much you have to spend on your next property and allows you to budget accordingly, however possibly having to rent or seek out alternative accommodation in the interim between selling and buying could incur additional costs that hadn’t previously been considered.  

Another way to buy a new property prior to selling your current home is with a bridging loan. A bridging loan is a short-term, interest only loan that is designed to “bridge the gap” between a debt and money due to come in. Bridging loans can be quicker to arrange and have more flexible terms than a mortgage, however they often have high rates compared to other loans. Bridging loans can usually only be arranged through a specialist lender.
